Welcome to OrellaUV! These Terms of Service (the “Terms”) govern your use of the orellauv.com website and any related services or sales (collectively, the “Services”) provided by MNTIOM j.d.o.o. (“OrellaUV”, “we”, “us”, or “our”). By accessing our website or placing an order with OrellaUV, you agree to accept and be bound by these Terms, so please read them carefully. If you do not agree, you should not use our site or services.

1. Use of the Site and Services

1.1 Eligibility: You must be at least 16 years old (or the age of legal consent in your country) to use our site or make a purchase. If you are under 16, please use the site only with the involvement of a parent or guardian. By using our site, you represent that you meet this age requirement.
1.2 Account Creation: To make a purchase or access some features, you may create a customer account. Ensure that all information you provide (name, email, payment details, etc.) is accurate and up-to-date. You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. If you suspect any unauthorized use of your account, notify us immediately. We reserve the right to suspend or terminate accounts that violate these Terms or for security reasons.
1.3 Acceptable Use: You agree to use our website and products only for their intended purposes and in compliance with all applicable laws and regulations. Do not attempt to misuse the site – for example, by introducing viruses, attempting fraud, or infringing on others’ rights. We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion if we believe a user is violating the law, these Terms, or the rights of others.

2. Products and Orders

2.1 Product Information: We strive to display our products as accurately as possible, including descriptions, pricing, and images. However, mistakes can happen. There may occasionally be typographical errors, inaccuracies, or omissions related to product descriptions, pricing, availability, or other details on our site. We reserve the right to correct any errors or update information at any time without prior notice. If such a correction affects your pending order (e.g., a pricing error on an item you’ve ordered), we will contact you and you may choose to reconfirm or cancel the order.
2.2 Placing an Order: When you place an order on orellauv.com, you are making an offer to purchase our product(s). After you submit your order, we will send an email confirmation. This email does not signify acceptance of your offer; it is just confirmation that we received your order. Our formal acceptance of your order (and the formation of a binding sales contract) occurs only when we dispatch the product to you. We reserve the right to decline or cancel any order for any reason before dispatch – for example, if a product is out of stock, if we suspect fraud, or if there are inaccuracies in pricing. If your order is canceled after payment, you will receive a full refund.
2.3 Availability: All product orders are subject to availability. OrellaUV products are popular wellness-tech items, and we update our stock regularly. In the rare case that an item is back-ordered or discontinued after you’ve ordered, we will notify you promptly and offer alternatives or a refund. We cannot guarantee continuous availability of any product until your order is accepted and shipped.
2.4 Intended Use: Our products are intended for personal, household use – they are not for resale or commercial redistribution without our permission. By purchasing, you agree not to resell or distribute our products for commercial purposes. If you are interested in wholesale or distribution, please contact us separately for a partnership agreement.

3. Pricing and Payment

3.1 Pricing: All prices on our website are listed in USD (United States Dollars) by default, or in local currency if selected. Prices include any applicable VAT or sales taxes where required by law (for example, VAT is included for EU customers at the appropriate rate). Shipping fees are separate (unless a free shipping promotion applies) and will be shown at checkout. We strive to ensure accurate pricing at all times. However, as noted, if we discover an error in the price of an item you ordered, we will inform you and give you the option to reconfirm at the correct price or cancel for a full refund before shipping.
3.2 Payment: We accept major payment methods (e.g. credit/debit cards, PayPal, and other methods as listed at checkout). By submitting an order, you authorize us (or our payment processor) to charge the full order amount (product price plus any shipping fees and taxes) to the payment method you provide. All payments are processed via secure encryption to protect your data. We do not store your full payment information on our servers.
3.3 Billing Information: You agree to provide current, complete, and accurate purchase and account information for all orders. Promptly update your account or notify us for any changes (billing address, card expiry, etc.) that could affect your transaction. False or unauthorized payment information is a breach of these Terms and may result in order cancellation.
3.4 Promotions and Discounts: From time to time, we may offer promotional codes, referral bonuses, or other discounts. These are subject to the specific terms of each promotion. Generally, only one promo code can be used per order, and promotions can’t be applied to past purchases. We reserve the right to modify or cancel promotions at any time.

4. Shipping & Delivery

We want you to receive your OrellaUV product as quickly and safely as possible. Please refer to our detailed Shipping Policy (below) for full information. Key points: once your order is placed, we typically process it within 1-3 business days. Shipping transit times vary by destination – e.g., around 7–15 days on average for most US & EU destinations (since we ship from our international warehouse), possibly longer for remote regions. You will receive a shipping confirmation email with a tracking number once your order is on its way. If any unexpected shipping delays occur (due to customs, carrier issues, etc.), we will communicate updates to you. In the event an order is significantly delayed or lost (not delivered within 60 days of shipment), we will offer you a full refund or send a replacement. By placing an order, you agree to our shipping terms and any applicable import duties as described in the Shipping Policy.

5. Returns & Refunds

For details on how to return a product or get a refund, please see our Return and Refund Policy above. In short: we offer a 30-day return period for any reason, and will honor refunds or replacements for damaged/incorrect items with proof. If you decide to return a product, you must follow the process in our policy (contact support, obtain return authorization, etc.). Refunds are processed back to the original payment method and may take several business days to reflect on your statement. We reserve the right to refuse a return or refund request if it falls outside our policy terms or the product returned is not in acceptable condition (e.g., missing major components), unless such denial would violate applicable law. However, we aim to be very accommodating and to exceed your legal rights where possible.

6. Product Use and Safety

6.1 Product Advice: OrellaUV products are innovative wellness-tech devices designed for consumer use. Please use the product only as directed in the user manual. We take safety seriously: our devices are tested and include safety features, but improper use (for example, disassembling the unit, using it for unintended purposes, or not following instructions) could result in injury or damage. We are not responsible for damages or injuries caused by misuse or abuse of the products.
6.2 Not Medical Devices: Unless explicitly stated, our products are not medical devices and are not intended to diagnose, treat, cure, or prevent any disease. Any wellness or health-related information on our site is for general informational purposes and is not a substitute for professional medical advice. Always consult a qualified healthcare provider for concerns about your health or before starting any wellness regimen.
6.3 Compliance: Our devices meet relevant safety and regulatory standards (such as CE and FCC certifications where applicable). As a user, you agree to use the product in compliance with all applicable local laws (for example, following any recycling/disposal regulations for electronic devices in your area).

7. Intellectual Property

All content on the OrellaUV website – including text, graphics, logos, images, audio clips, and software – is the property of MNTIOM j.d.o.o. (OrellaUV) or its content suppliers and is protected by copyright, trademark, and other intellectual property laws. The name “OrellaUV”, our logos, and all related product names are our trademarks. You are not permitted to use these marks without our prior written permission. You may access and view content on our site for personal use, but no commercial use, reproduction, or distribution of any site content is allowed without authorization. If you contribute content (e.g., product reviews or testimonials), you grant us a right to use that content for marketing or other purposes. 8. Limitation of Liability

8.1 General: We strive to provide you with an excellent experience, but in legal terms, our liability to you is limited. To the fullest extent permitted by law, OrellaUV (MNTIOM j.d.o.o.) shall not be liable for any indirect, consequential, incidental, or punitive damages arising out of or related to your use of the site or products. This includes, for example, damages for lost profits, loss of data, or emotional distress.
8.2 Cap on Liability: To the extent permitted by law, the maximum aggregate liability of OrellaUV for any claims arising from your use of the Services or purchase of products is limited to the amount you paid us for the product in question. If the claim does not relate to a product purchase, our maximum liability will be €100.
8.3 Exceptions: Nothing in these Terms limits or excludes our liability for gross negligence, willful misconduct, or any other liability that cannot be limited or excluded by law. For example, we do not limit liability for personal injury or death caused by our product’s proven negligence. Your consumer rights are not limited by this section. In some jurisdictions, you may have specific legal remedies that cannot be waived, and we respect those.
8.4 Product Guarantee: All genuine OrellaUV products come with a standard 2-year European legal guarantee against defects in materials and workmanship (or any minimum warranty period required by law in your region). If your product malfunctions due to a manufacturing defect within that period, contact us for repair or replacement under warranty. This warranty is separate from our return policy and does not cover damage due to accidents or misuse. Aside from such express warranty and your statutory rights, we make no further warranties. We provide the website and products “as is” and disclaim any implied warranties of merchantability or fitness for a particular purpose to the extent allowed by law. 【This means that outside of the promises we explicitly make, we don’t guarantee anything else – but of course we stand by our products and will always work to resolve any issues fairly.】

9. Governing Law and Dispute Resolution

9.1 Governing Law: These Terms and any disputes arising from your use of our services or products shall be governed by the laws of the Republic of Croatia, excluding its conflict of laws principles. However, if you are a consumer in the EU or UK, you are also protected by the mandatory consumer protection laws of your country of residence, which may grant you certain rights. These Terms are intended to comply with such laws.
9.2 Dispute Resolution: We genuinely hope never to have a dispute with our customers – your satisfaction is our goal. If you have any concerns or disputes with OrellaUV, we encourage you to contact us first at support@orellauv.com and we will try our best to resolve the issue amicably. In the unlikely event we cannot resolve it directly, and you reside in the EU, you have the right to seek resolution through the EU Online Dispute Resolution (ODR) platform or through your local consumer authority. Otherwise, any legal claim arising from these Terms or your use of our website shall be brought in the competent courts of Croatia (unless otherwise required by consumer law).
9.3 No Class Actions (US only): Please note, if you are a customer in a jurisdiction that allows class action waivers (e.g., the United States), you agree that any dispute will be resolved only on an individual basis and not as part of any class or representative action. (This clause does not apply if such waivers are not permitted by your local law.)

10. Changes to These Terms

We may update or modify these Terms from time to time to reflect changes in our services, legal obligations, or for other operational reasons. When we make changes, we will post the updated Terms on this page with a new “Last updated” date, and if the changes are significant, we may additionally notify you via email or a notice on our site. Continued use of our site after updates constitutes acceptance of the new terms. If you do not agree with any updated terms, you should stop using our Services and may close your account at any time.
